California Employment Laws

Discrimination Defined

The Fair Employment and Housing Act protects employees from discrimination through the following:

  • Union participation

Most people understand discrimination to be based on one's membership in a protected class which is a significant part of the equation, but another critical factor is the context in which it occurs.

For example, an employer could be guilty of gender discrimination if they terminate a female employee after finding out she is pregnant.

Another example would be if an employer gives more vacation and a higher salary to white employees than people of color.
