Who Can File a Wrongful Death Suit?
After the loss of a loved one, the surviving immediate family can take legal action against the wrongful or negligent party that caused the accident responsible for the death. California Code of Civil Procedure section 337.60, et seq. allows for spouses, domestic partners, and surviving children to file a wrongful death lawsuit. If none exist, surviving beneficiaries, such as parents or siblings, may file a suit.
In addition, California law allows those who can prove they were financially dependent on the deceased to file a wrongful death lawsuit. This can include cohabitating, but not legally married, “putative” spouses or stepchildren.
We Can Help Hold the Negligent Party Accountable
California law places a two-year statute of limitations on wrongful death cases against negligent parties. Waiting to pursue a claim can cause crucial evidence to be lost and only prolong the anguish your family is facing. If the reckless, careless, or criminal actions of another caused the death of your beloved family member, you have a right to hold the responsible parties accountable.
The damages awarded in a successful wrongful death or survival case may include:
- Funeral and burial expenses
- Medical and hospital bills from treating your loved one
- Lost income that would have been provided by your family member
- Loss of physical and emotional support, including care, comfort, and companionship
